These Terms & Conditions apply to private purchasers only and is a Consumer Contract between EOL Online Store (EOL) and you the purchaser (purchaser). Product Condition Unless otherwise stated, all hardware goods/equipment offered on this site are second-user. EOL warrants that all such equipment has been tested, cosmetically cleaned and broadly functions in the manner for which it was originally intended. EOL is not responsible for the cosmetic appearance of the equipment in so much as that does not hinder its actual operation. EOL offers no warranty whatsoever on consumables (e.g. toner cartridges etc.), or on batteries supplied with Laptops/Notebooks. EOL does not test the life expectancy of these batteries, although the equipment is tested in line with our normal practices and procedures. The purchaser is wholly responsible for deciding on the suitability of the goods offered and by placing an order acknowledges the goods as being suitable. Warranty/Returns Policy All items, unless stated, come with a 6 month return to base warranty. In addition EOL grants a cooling off period for goods purchased where the purchaser has changed his/her mind. This period is 14 days from receipt of the order providing he/she notifies EOL in writing via e-mail (returns@eolonline.co.uk) to obtain return instructions and is subject to the conditions given below.
If the purchaser wishes to change his/her mind under the Distance Selling Act 2000 then he/she is responsible for the cost of returning the goods. 10% of the price paid for the item(s) shall be allocated to the delivery part of the order. This amount is non-refundable.
If goods are returned due to incorrect specification, malfunctioning or damage in transit, then the purchaser must, before returning the goods, contact EOL via e-mail (returns@eolonline.co.uk) for return instructions. Goods returned, for whatever reason, must be in the same condition, unless damaged in transit, as when they were despatched from EOL and protected in the original packaging together with proof of purchase and must be accompanied by any peripherals supplied in the same transaction.
In the case of returned software, the packaging must be totally intact and no seals broken. If seals and/or packaging have been tampered with then EOL refuses to make a refund under any circumstances.
Any goods returned to EOL:
· Without a valid RMA reference number; · Not in original packaging; · Without proof of purchase; · Damaged (unless sustained in transit); · Without accompanying peripherals;
then EOL has the right to return the goods to the purchaser and waive the purchaser’s rights to a refund.
In the case of the purchaser claiming faulty equipment as the reason for return EOL will examine the goods to determine the nature and cause of the reported defects.
In the event that the examination confirms there is a fault with the goods which was not caused by misuse, neglect, accident, improper storage, alteration or repair on the part of the purchaser, then EOL will arrange to refund to the purchaser the purchase price and where applicable the outbound carriage. If no defects are found then EOL may ship the goods back to the purchaser at the purchaser's expense and no refund will be made; EOL will inform the purchaser in writing before such action is taken to allow time for the appeal. Delivery Our standard delivery time is 2-3 working days. Delivery commitments are entered into in good faith but are not guaranteed, and EOL shall not be liable or any loss or damage occasioned by failure to deliver on the specified date howsoever caused. Nor shall failure be deemed to be breach of the Contract, or any of its conditions, or part thereof Liability The goods are supplied to the purchaser for private use only and this is a consumer contract. EOL accepts no liability for any private/business loss (which includes without limitation any loss of contracts, loss of profits, loss of revenue or any loss or corruption of data) as a result of either our breach of these terms or our negligence or any other circumstances. Statutory Rights and Distance Selling The terms of the Warranty and Returns process are in addition to the purchaser's statutory rights. If the purchaser has any doubts about his/her statutory rights then please contact your local Trading Standards department or Citizen's Advice Bureau.
